Foreclosure Trustee Services

A disciplined process for commercial real estate enforcement, from assignment review through an authorized sale and the required closing documentation.

Who we work with

For secured lenders, loan servicers, and their counsel considering a foreclosure trustee assignment. AGIMANO focuses on document control, procedural tracking, and coordination across the parties responsible for carrying out the process.

When procedural discipline matters

  • A commercial real estate loan has moved from workout discussions toward enforcement
  • Loan transfers or servicing changes have created documentation gaps
  • Multiple parties need a clear record of notices, milestones, and responsibilities
  • A pending payoff, reinstatement, dispute, or bankruptcy filing may affect the next step
Scope of work

What the assignment can cover.

Review the assignment

Organize the loan and security documents, assignment history, title information, and relevant instructions. Identify missing materials and confirm the proposed role with counsel before the process advances.

Track notices and sale steps

Coordinate notice and sale administration within the applicable requirements. Maintain a milestone record, document communications, and track changes to instructions or timing.

Coordinate completion

Work with counsel and title providers on authorized sale procedures and the documentation required after completion. Track payoff or reinstatement information when applicable and maintain a clear assignment file.

From review to execution

A defined process. Clear responsibilities.

01

Confirm authority and readiness

Review eligibility, appointment, governing documents, and the property’s jurisdiction. Establish responsibilities and any unresolved prerequisites.

02

Administer and document

Coordinate the required process, record completed steps, and escalate matters that may affect whether or when an action can proceed.

03

Close and hand over

Complete the authorized documentation and coordinate the transition with the appropriate parties. Separate sale administration from any later property-management assignment.

Prepare for a discussion

Start with the property and the immediate issue.

An initial discussion establishes the situation, timing, and whether the proposed assignment fits. Supporting materials can follow through an agreed information-sharing process.

  • Property location and the recorded security instrument
  • Loan documents, assignments, and current servicing information
  • Title report, payment history, and the status of default notices
  • Counsel contacts and any litigation, bankruptcy, or payoff developments
Common questions
Are foreclosure procedures the same in every state?

No. Requirements, timing, trustee eligibility, and available procedures depend on the jurisdiction and the governing documents. Those issues are reviewed with counsel for each proposed assignment.

Does a trustee assignment include property management?

The scope is defined for the assignment. Foreclosure administration does not automatically include managing the property. If operating oversight is also needed, a separate management or receivership role must be evaluated.

Trustee engagements depend on jurisdiction, eligibility, appointment, and applicable legal requirements. Legal strategy and advice remain with counsel.

Commercial & multifamily real estate

Property details drive the analysis.

Retail and shopping centers, hotels and hospitality, office buildings, and multifamily communities each carry different operating needs. The review accounts for tenancy, management, capital requirements, and the financing or legal issues affecting that asset.
