Real Estate Bankruptcy & Litigation Support
Keep the property’s economics visible when bankruptcy proceedings, ownership disputes, or enforcement litigation complicate the path forward.
For counsel, lenders, creditors, owners, and investors seeking real estate and financial support in a contested or court-supervised situation. AGIMANO focuses on the property, operating information, liquidity requirements, and practical transaction alternatives.
When legal complexity meets operating pressure
- A real estate bankruptcy requires a clear view of cash needs and operating performance
- An ownership dispute has interrupted decisions, records access, or capital contributions
- Stakeholders need to compare a negotiated resolution with a sale or restructuring
- A proposed transaction must be evaluated alongside litigation and procedural constraints
What the assignment can cover.
Organize the financial record
Assemble property operating information, debt schedules, cash balances, and capital requirements. Identify inconsistencies, missing information, and assumptions affecting the economic analysis.
Assess liquidity and operations
Develop cash-flow scenarios, review operating budgets, and evaluate the effect of vacancies, maintenance, and working-capital needs. Separate immediate funding needs from longer-term capital requirements.
Support resolution analysis
Compare commercial alternatives and prepare property and financial materials for counsel and authorized stakeholders. Coordinate transaction and operating workstreams with the requirements of the proceeding.
A defined process. Clear responsibilities.
Define the questions
Agree on the financial and real estate issues to be addressed, the available information, and the engagement’s scope and reporting audience.
Build the supporting analysis
Reconcile the records, document assumptions, and evaluate sensitivities. Distinguish verified information from estimates and unresolved issues.
Support decisions and implementation
Present the economic implications of the available paths and update the analysis as the proceeding, property, or proposed transaction changes.
Start with the property and the immediate issue.
An initial discussion establishes the situation, timing, and whether the proposed assignment fits. Supporting materials can follow through an agreed information-sharing process.
- Case or dispute summary, key parties, and relevant deadlines
- Property operating records, rent rolls, and cash-flow forecasts
- Debt documents, ownership information, and capital requirements
- Counsel contacts, relevant orders, and the questions the analysis must address
Does this service include legal representation?
AGIMANO’s role is real estate, operating, and financial support. Legal advice, filings, litigation strategy, and legal representation are handled by the client’s counsel.
How does this relate to receivership or DIP financing?
The analysis may identify a need for independent property oversight or financing during bankruptcy. A receivership or financing engagement is evaluated separately, with its own scope, eligibility, documentation, and approvals.
Work is coordinated with counsel and remains subject to the engagement terms and any applicable court orders. A support engagement does not itself confer authority over the property.
Property details drive the analysis.
Retail and shopping centers, hotels and hospitality, office buildings, and multifamily communities each carry different operating needs. The review accounts for tenancy, management, capital requirements, and the financing or legal issues affecting that asset.
